Amendments of Emiri decree No. 17/2015 of establishing Naufar Centre.

 

Article (1)

In implementing the provisions of this decree, each of the following words and phrases shall have the meaning attached thereto unless the context requires otherwise:

Ministry: Ministry of Public Health.

Minister: Minister of public Health.

Center: Naufar center.

Director General: The Director General of the center.

Addiction: A chronic recidivistic disease that affects the brain as a result of the harmful intake of a psychoactive medicine, or a drug or an intoxicant that poses health risks or causes disorders with pathologic symptoms thereby pushing the individual to persistently seek drugs and intoxicants and compulsively use the same.

 

Article (2)

A centre called “naufar Centre” shall be established, which will be affiliated with the Ministry and shall have a juristic personality and a budget that is associated with that of the Ministry. The Centre shall have its head office in the City of Doha.

 

Article (3)

The center aims to provide remedial and rehabilitative services, and to integrate community care for patients with addiction.  The services shall be reinforced by educational and applied research, in accordance with the policies adopted by the ministry and within the framework of the methodology used in the hospitalisation resorts. In doing so, the Centre may exercise all the authorities and competences required for this purpose, namely:

  1. Cooperate with the various relevant internal and external stakeholders in this field;
  2. Prepare and implement subsequent follow-up of healthy patients and reintegrate them into society, and secure employment and educational opportunities in coordination with the competent authorities;
  3. Improve the image of the addicts as patients needed help and care, in coordination with the competent authorities.
  4. Organize Conferences and scientific symposiums in all fields and specializations, relating to addiction issues and treatment, which fall within the jurisdiction of the center.
  5. Plan community events and publish educational and awareness materials aim to educate the community on addiction, and raise awareness of how to deal with an addict, in coordination with the competent authorities.
  6. Conduct research and clinical scientific studies related to treatment, rehabilitation, and prevention programs and the efficiency thereof and how to develop them.
  7. Provide evidence-based data to monitor addiction in the society and identify it and implement international best practices in addiction therapy;
  8. Build local capabilities in addiction treatment and rehabilitation, through education and training programs organized by the Centre in cooperation with educational institutions, in coordination with the competent authorities.
  9. Participate in international seminars and conferences related to addiction treatment and rehabilitation.

Article (4)

The Centre shall put in place the systems for protecting the identities of patients receiving

treatment services and keeping their information confidential. Such identities and information may not be disclosed unless by virtue of a court order or judgment.

 

Article (5) 

The Centre shall have a Director General, who shall be appointed by a decision of the Minister. The Centre may also have an assistant director, who shall be appointed by a decision of the Minister and whose competences shall be determined in the same decision.

 

Article (6)

The Director General shall provide executive direction and technical, financial and administrative management to achieve the objectives of the center, in the framework of the general policy of the Ministry, and in accordance with the laws, regulations and decisions in force, and have a particular exercise the following functions:

  1. Propose strategies, action plans and programs and to present the same before the Minister for approval and to supervise the implementation of the same.
  2. Propose short-term plans and present the same before the Minister for approval.
  3. Appointment of administrative and technical personnel qualified to work for the center after the approval of the Minister.
  4. Drafting the annual budget and the final account proposal.
  5. Decision-making and the signing of the transactions falling within his competence.
  6. Any other task assigned by the Minister in his purview.

 

Article (7)

The Director General shall represent the Centre before courts and in its relationships with third parties.

 

Article (8)

The organizational structure of the Centre and the administrative units and sections therein,

and the competences thereof shall be determined by a decision of the Minister upon a proposal by the Director General.

 

Article (9)

The Centre shall put in place its internal regulations, namely the administrative, financial and technical regulations that would enable him to provide the optimal level of comprehensive treatment, rehabilitation and precautionary level of services for Addiction patients. Such regulations may not come into effect unless approved by the Minister upon the Director General’s proposal.

 

Article (10)

Financial resources of the center consist of the following:

  1. Funds allocated by the state.
  2. Revenue derived from the center’s activities.
  3. Donations and grants approved by the cabinet.

 

Article (11)

The fiscal year of the center start and end with the beginning and the end of the financial year of the State. The first financial year of the center of start with the date of this decree, and ends at the end of the fiscal year for the state.

 

Article (12)

Minister of Finance may appoint an auditor(s) to audit the accounts of the Centre.

The auditor, at any time, may access the books and documents of the Centre and request the information he deems necessary to carry out his duties in the right way, and he has the right to audit the assets and liabilities of the centre.

The auditor shall submit an annual detailed report to the minister of finance including his suggestions and recommendations.

 

Article (13)

The Director General shall submit annual reports to the Minister on the administrative, financial and technical progress of the center, including his suggestions and recommendations.

The Minister may request the Director-General, at any time, to submit the reports referred to, or other related in any of other activities.

 

Article (14)

Upon a proposal by the Director General, the Minister shall issue the regulations and decisions required to enforce the provisions of this Decision.

 

Article (15)

All competent authorities, as appropriate, implement the decree, and shall be effective from the day following its publication in the Official Gazette.
